Walter J. Zable, namesake for W&M's football stadium, dies

In 1935, the College of William and Mary played its inaugural football game at its newly dedicated Cary Field stadium, battling the University of Virginia to a 0-0 tie.

Walter Joseph Zable, who would earn a bachelor's degree in mathematics and physics from William and Mary in 1937, played in that game.

Mr. Zable, who turned down a scholarship from Harvard University to accept one in Williamsburg, became an honorable mention All-American in football and lettered in baseball, basketball and track. He later played for the Richmond Arrows.

William and Mary is where he met Betty Virginia Carter, a 1940 alumna he married while he was still in school.

Staunch school supporters, the Zables gave their alma mater $10 million in 1990, which prompted the board of visitors to rename the football and track and field venue Zable Stadium at Cary Field.

Williamsburg and Tribe athletics remained close to Mr. Zable's heart until he died Saturday at 97 in a San Diego hospital.

Arrangements for a memorial service are pending.

"Every college and university has a few graduates who are larger than life, whose accomplishments are simply extraordinary, and whose loyalty to their alma mater is the stuff of legend," said W. Taylor Reveley III, president of William and Mary.

"Walt Zable was such an alumnus at the College of William and Mary. He was deeply devoted to William and Mary -- one of those alumni for whom lifelong ties to his alma mater meant a lot to him.

"He was particularly generous in annual giving ? the lifeblood of the college operating budget.

"The last time I saw him at the college and had him to lunch, we drove around in a golf cart. He was extremely interested in seeing all the new construction, especially the athletic facilities."

Bobby Dwyer, senior associate athletic director for development at the school, noted that "whether it was giving for scholarships, facilities, endowments, whatever ? he was always there. And he was so generous that he inspired others to give."

At his death, Mr. Zable, who was founder and still president, CEO and chairman of Cubic Corp., was the oldest chief executive of any publicly traded company.

A Los Angeles native, he grew up in Boston, where a crystal set ignited a lifelong interest in electronics. He returned during the early 1940s to California, where he started a microwave technology business in his garage. He moved his business to Point Loma, Calif., where Cubic debuted its first profitable product in 1951 ? a device that measured the power of microwaves.

Cubic was a pioneer in postwar electronics, developing products like automatic elevators, electronic sports scoreboards and electronic voting equipment. It also had made distance-measuring devices that revolutionized offshore activities such as oil drilling and laying pipe.

The San Diego-based engineering and technology business, which employs more than 7,800 workers and posted revenue last year of $1.28 billion, now is known as a defense contractor that supplies electronic flight and ground forces training systems to militaries, produces mission-support services to the Pentagon and makes automated fare payment equipment for some of the world's largest public transit systems.

Mr. Zable's wide philanthropic interests included California colleges and his community.

He had been a director of the National Football Foundation and the College Football Hall of Fame, which inducted him in 1981.

His wife died in 2007. Survivors include a son, Walter C. Zable of Del Mar, Calif.; a daughter, Karen Cox of Danville, Ky.; and five granddaughters.

US exempts China from Iran oil sanctions for 6 months

The United States has granted China a last-minute, six-month exemption from financial penalties for buying Iranian oil, as the latest trance of US sanctions aimed at Iran?s crude exports kicked in on Friday.

According to Reuters, Secretary of State Hilary Clinton said both China and Singapore, which was also granted a temporary reprieve, had earned the exemption by cutting imports of Iranian crude, and insisted in a statement that the reductions carried out by Iran?s 20 major oil buyers ? all of whom have now been exempted from the latest sanctions ? had made a clear impact:

?Their cumulative actions are a clear demonstration to Iran?s government that Iran?s continued violation of its international nuclear obligations carries an enormous economic cost,? she said.

Under US legislation that came into force at the end of 2011, countries had to show they had made significant reductions to the amount of crude they importing from Tehran by June 28, on penalty of being shut out of the US financial system, according to the BBC.

Chinese imports from Iran dropped sharply over the first five months of this year, but this was mainly due to an ongoing pricing dispute.

The sanctions are intended to pressure Iran into halting its controversial uranium enrichment program, which Tehran insists is for purely civilian purposes. According to The Financial Times, the measures have sharply cut Iran?s crude exports, with some analysts predicting that monthly exports may be almost halved next month from July 2011.

China has opposed the latest set of US sanctions, which ban firms that engage with the Iranian central bank from business in the US. Officials in Beijing insisted earlier this month that purchases of Iranian crude are ?legitimate,? The Wall Street Journal reported.?

Searching for the origin of muscles

ScienceDaily (June 28, 2012) ? A characteristic feature of most animals is their ability to move quickly with the help of their musculature. Animals that can move are able to flee, hunt for prey, travel long distances or conquer new habitats. The evolution of muscles was thus a fundamental step during animal evolution. While the structure and function of muscles, especially of vertebrates, have been intensively studied, the evolutionary origin of smooth and striated muscles has so far been enigmatic. Comparative genome and gene expression studies, performed by researchers Patrick Steinmetz, Johanna Kraus and Ulrich Technau in an international collaboration with researchers from Germany, France and Australia, revealed the origin muscle components in ancestral animals such as sea anemones, jellyfish or sponges.

Gene duplication

Phylogenetic comparisons showed that one of the crucial structural proteins of striated muscles of vertebrates, a "myosin" motor protein, originated by gene duplication. "As this specific myosin has so far only been found in muscle cells, we expected that its origin coincided with the evolution of muscle cells. We were very surprised to see that the 'muscle myosin' evolved probably in unicellular organisms, long before the first animals lived," explains Ulrich Technau who led the study.

Research in sponges ?

"In sponges, that all lack muscles, the 'muscle myosin' appears to play a role in regulating the water flow," comments Gert W?rheide (Ludwig-Maximilians-Universit?t Munich), whose team was investigating muscle proteins in sponges together with Michael Nickel (University of Jena) and Bernard Degnan (University of Queensland).

Jellyfish occupy a special phylogenetic position to understand the evolution of muscles. They are cnidarians, an animal group that originated more than 600 million years ago, and possess striated muscles. Due to the striking similarities between striated muscles of vertebrates and jellyfish, it was so far assumed both striated muscle types share a common origin. In fact, jellyfish striated muscles also express the ancient "muscle myosin," but they lack several essential components that are characteristic for the structure and function of striated muscles of "higher animals."

This indicates that despite their striking similarities, striated muscles of jellyfish and "higher animals" have evolved independently. This study sheds light onto how seemingly complex biological structures, such as striated muscles, could have evolved independently based on very ancient components.

(AP) ? The U.S. economy is growing too slowly to pull the job market out of a slump, according to data that suggests June will be another weak month for hiring.

Applications for unemployment benefits stayed above a level generally considered too high to lower the unemployment rate. And the annual growth rate for the January-March quarter was unchanged at a tepid 1.9 percent.

The two government reports released Thursday added to the picture of an economy that is faltering for the third straight year after a promising start. Job growth has tumbled, consumers are less confident and Europe's financial crisis has dampened demand for U.S. exports.

Most economists don't see growth accelerating much from the first-quarter pace, although some are hopeful that lower gas prices could help lift consumer spending over the summer.

Growth of around 1.9 percent typically generates roughly 90,000 jobs a month. That's considered too weak to lower the unemployment rate, which was 8.2 percent last month.

Slow improvement in the economy threatens President Barack Obama's re-election hopes. He is likely to face voters with the highest unemployment rate of any president since the Great Depression.

The Federal Reserve last week downgraded its outlook for 2012 growth. The Fed now predicts the economy will grow between 1.9 percent and 2.4 percent this year ? a half a percentage point lower than its forecast in April. And it doesn't see the unemployment rate falling much lower this year.

Hiring isn't likely to improve in June, based on the level of people applying for unemployment benefits.

Weekly applications fell last to a seasonally adjusted 386,000, the Labor Department said. But they have climbed nearly 5 percent in the past two months.

When applications are above 375,000, it generally means that hiring isn't strong enough to rapidly lower the unemployment rate.

Economists are predicting 100,000 jobs were added in June and no change in the unemployment rate, according to a survey by FactSet. The government will issue the June employment report on July 6.

"Jobless claims are still too high and show that employment growth is slowing and no progress is being made," said Jennifer Lee, an economist at BMO Capital Markets.

Employers added an average of only 73,000 jobs per month in April and May after averaging 226,000 a month in the first three months of the year.

The report on the first quarter's economic growth showed that U.S. corporate profits fell, the first quarterly decline since the final three months of 2008.

U.S. corporations earned less profit overseas, the report said. That's likely a result of Europe's economic woes and slowing growth in countries like China and India. And it could prevent U.S. employers from adding some jobs in the second half of the year.

"With global weakness continuing ... corporate profits are likely to remain under pressure, a development that is unlikely to help the employment outlook," said Jeremy Lawson, an economist at BNP Paribas.

The number of people continuing to receive benefits, meanwhile, rose to 5.9 million in the week ended June 9, the latest data available. That's about 70,000 more than the previous week.

Other recent indicators have painted a mixed picture of the economy.

A closely watched private survey released this week showed consumer confidence fell in June for the fourth straight month. The Conference Board said worries about the job market outweighed lower gas prices and steady improvement in the housing market.

Americans have received little in the way of pay raises this year, with wage growth trailing inflation. That has started to slow their growth in spending. Retails sales have barely grown in the past two months.

Less growth in consumer spending has also hurt U.S. manufacturing activity, a leading economic driver since the recession ended. Factories produced less in May than April, the Federal Reserve said this month. Automakers cut back on output for the first time in six months.

There have been hopeful signs.

Gas prices have plummeted since peaking in April near $4 per gallon. The average national price for a gallon of gas was $3.37 on Thursday, according to auto club AAA, Wright Express and the Oil Price Information Service.

U.S. factories received more orders for long-lasting manufactured goods in May, while a key measure of business investment plans rose.

And Americans are starting to gain more confidence in the long-suffered housing market. Home sales are up from last year and signed contracts to buy homes matched a two-year high in May.

Mortgage rates have fallen to the lowest levels on record, while home prices have started to rise in most cities. And homebuilders are planning to break ground on more projects in the next 12 months.

Lets take a quick look at the market in Houston right now...

Last May marked the 12th consecutive month of positive sales and growth in the Houston real estate market. The sales of single-family homes rose 29% since May of last year with and 8.5% increase in average sales price. Strong sales on homes from $250,000 and up pushed the average housing price up to historic levels.

For potential investors, probably the most important statistic is month end pending sales, which totaled 4,476, up 10.5% since last May. This suggests a further increase in sales for the upcoming months. Foreclosed sales totaled 7,327 in May, an increase of over 24% from that of last year. The large volume of sales has caused the price of these foreclosed homes to rise 4.1% to over $80,000 per home.

All this positive news may come as a surprise to many people. It is true, buyers and sellers alike are experiencing a national market filled with over-appreciated homes and a shortage of home-buyers. Texas seems to be the anomaly. Why?

Texas has an impressive 11.5% estimated profit increase according to the ROI. Of course, profit increase doesn't mean much to investors who have trouble finding tenants, such as in areas with high unemployment like California and Detroit. It's a good thing that Houston is a job creating machine that expects to have created more than 810,000 new jobs by the end of 2012.

Is Houston good for foreign investors?

In the past year, Texas has accounted for 10% of all international sales by foreign investors, coming in 3rd behind Florida (26%) and California (16%). There are a couple of reasons why foreign investors have suddenly turned their eyes toward the Lone Star. First, Texas has the single most self-sustaining economy in the country, experiencing stable growth on all levels. Second, Texas is one of the easiest states for foreign investors to set up an LLC.

Homes are going fast with an 18.1% decline in available listings over the past year. Also, the number of available single family homes has reached its lowest point in the past 5 years. The market is in a position where the sooner you act, the more returns you're likely to earn.

(AP) ? Americans signed more contracts to buy previously occupied homes in May, matching the fastest pace in two years. The increase suggests consumers are gaining confidence in the housing market and a modest recovery will continue.

The National Association of Realtors said Wednesday that its index of sales agreements increased to 101.1 last month from 95.5 in April. That matches March's reading, the highest since April 2010, when a home-buying tax credit boosted sales.

A reading of 100 is considered healthy. The index is 13.3 percent higher than it was a year ago. It bottomed at 75.88 in June 2010, after the tax credit expired.

The increase supports other data showing steady improvement in the housing market this year, even as hiring slumps and consumer confidence sags.

Sales of new and previously occupied homes are up over the 12 months. Builders are starting more projects. And prices are rising in most markets.

"Despite the gloom in much of the recent economic data, housing continues to show real signs of life," said Ian Shepherdson, chief U.S. economist at High Frequency Economics.

The economy benefits when home sales rise. Buyers typically spend more on renovations, furniture, appliances and landscaping.

There's also a psychological factor. In good times, most homes rise in value. When homes appreciate, people feel they have more money. So they spend more. Consumer spending drives roughly 70 percent of economic activity.

It typically takes one to two months for buyers to close on a home after signing a contract. So the increase in signed contracts suggests completed home sales will rise this summer. That could drive prices higher and encourage more people to put homes on the market.

Home prices increased in 19 of 20 major U.S. cities in April from March, according to the Standard & Poor's/Case-Shiller index, released Tuesday. A measure of national prices rose 1.3 percent in April, the first increase in seven months.

Still, sales remain far below healthy levels. Analysts say it could be years before the housing market returns to full health.

One reason prices are rising is the supply of homes for sale remains extremely low. The inventory of previously occupied homes for sale is back down to levels last seen in 2006. And there were 145,000 new homes for sale in May, just 1,000 higher than in April, which was the lowest supply on records dating back to 1963.

The Realtors group cautioned that sales could slow if more people don't list their homes.

The limited inventory should spur more home building, the Realtors group said. If housing starts don't increase, the limited supply could drive up prices.

In May, contract signings increased in all regions. The largest rise was in the West, where the index jumped 14.5 percent in May. Signings rose 6.3 percent in the Midwest, 4.8 percent in the Northeast, and 1.1 percent in the South.

Despite the modest gains in housing, the broader economy has weakened in recent months. Employers have added an average of only 73,000 jobs a month in April and May. That's much lower than the average of 226,000 added in the first three months of this year.

WASHINGTON (AP) ? Broadcasters anticipating a major constitutional ruling on the government's authority to regulate what can be shown and said on the airwaves instead won only the smallest of Supreme Court victories Thursday.

The justices unanimously threw out fines and other penalties against Fox and ABC television stations that violated the Federal Communications Commission policy regulating curse words and nudity on television airwaves.

Forgoing a broader constitutional ruling, however, the court concluded only that broadcasters could not have known in advance that obscenities uttered during awards show programs on Fox stations and a brief display of nudity on an episode of ABC's "NYPD Blue" could give rise to penalties. ABC and 45 affiliates had been hit with proposed fines totaling nearly $1.24 million.

Broadcasters had argued that the revolution in technology that has brought the Internet, satellite television and cable has made the rules themselves obsolete. The regulations apply only to broadcast channels.

The justices said the FCC is free to revise its indecency policy, which is intended to keep the airwaves free of objectionable material during the hours when children are likely to be watching.

The agency's chairman, Julius Genachowski, said the ruling "appears to be narrowly limited to procedural issues related to actions taken a number of years ago. Consistent with vital First Amendment principles, the FCC will carry out Congress's directive to protect young TV viewers."

It was the second time the court has confronted, but not ruled conclusively on the FCC's policy on isolated expletives. Justice Anthony Kennedy said in his opinion for the court that "it is unnecessary for the court to address the constitutionality of the current policy."

The narrow decision, coupled with the more than five months that elapsed between the argument in January and Thursday's decision, could mean that the justices struggled and failed to reach agreement on a broader outcome.

Broadcasters argue that viewers now have many options, unlike the handful of channels they had available in the 1960s and 1970s when the court last weighed in on indecency on the airwaves. In many cases, viewers don't even know when they are switching between the older broadcast channels and cable.

Still, the regulated broadcast channels provide what the government has called a safe haven of milder programming, and those channels remain dominant, even in the Internet age, the administration argued.

Paul Smith, a First Amendment expert and partner with the Jenner and Block law firm in Washington, said the court should expect more challenges until it rules definitively.

"The Supreme Court decided to punt on the opportunity to issue a broad ruling on the constitutionality of the FCC indecency policy. The issue will be raised again as broadcasters will continue to try to grapple with the FCC's vague and inconsistent enforcement regime," said Smith, who wrote a brief supporting the broadcasters.

The case arose from a change in the FCC's long-standing policy on curse words.

For many years, the agency did not take action against broadcasters for one-time uses of curse words. But after several awards shows with cursing celebrities in 2002 and 2003, the FCC toughened its policy after it concluded that a one-free-expletive rule did not make sense in the context of keeping the airwaves free of indecency when children are likely to be watching television.

But Kennedy, in the ruling throwing out the fines, said the commission did not adequately explain that under the new policy "a fleeting expletive or a brief shot of nudity could be actionably indecent."

The stepped-up indecency enforcement, which included issuing record fines for violations, also was spurred in part by widespread outrage following Janet Jackson's breast-baring performance during the 2004 Super Bowl halftime show on CBS.

That incident and the FCC's proposed fine of $550,000 are not part of the current case. The government has an appeal pending of a lower court ruling that threw out the fine in that case.

The 2004 Super Bowl took place before the FCC later that year laid out its new policy and the possibility of fines for even one-time utterances of certain words.

Tim Winter, president of the Parents Television Council, said he read the new decision as a "green light" for the FCC to rule against broadcasters in the many pending complaints of indecent material that aired after the FCC explained its new policy.

"Once again the Supreme Court has ruled against the networks in their yearslong campaign to obliterate broadcast decency standards," Winter said.

The material at issue in Thursday's decision included the isolated use of expletives as well as fines against broadcasters who showed a woman's nude buttocks on a 2003 episode of "NYPD Blue."

In December 2002, singer Cher used the phrase "F--- 'em" during the Billboard Music Awards show on the Fox television network. A month later, U2 lead singer Bono uttered the phrase "f------ brilliant" during NBC's broadcast of the Golden Globes awards show. During the December 2003 Billboard awards show on Fox, reality show star Nicole Richie said, "Have you ever tried to get cow s--- out of a Prada purse? It's not so f------simple."

But the challenge went beyond just the penalties for the use of fleeting expletives.

The broadcasters wanted the court to free them from all regulation of content around the clock. The court's 1978 Pacifica decision upheld the FCC's reprimand of a New York radio station for airing a George Carlin monologue containing a 12-minute string of expletives in the middle of the afternoon.

Justice Ruth Bader Ginsburg said in a brief opinion that she would have overturned the Pacifica ruling, which she called wrong even when it was decided. Justice Sonia Sotomayor did not take part in the current case because she was involved in an earlier version while sitting as an appeals court judge in New York.

The case is FCC v. Fox, 10-1293.

Misidentified and contaminated cell lines lead to faulty cancer science

Modern cancer therapies start in cells ? researchers compare cancer samples to healthy cells to discover how cancer is genetically different, and use cell lines to test promising new drugs. However, a University of Colorado Cancer Center study published this week in the journal Gynecologic Oncology shows that due to a high rate of contamination, misidentification and redundancy in widely available cell lines, researchers may be drawing faulty conclusions.

"I've seen faculty and graduate students leave my lab in tears when we discovered the cells on the label weren't the cells they were actually experimenting on," says Christopher Korch, PhD, investigator at the CU Cancer Center and director of the center's DNA Sequencing and Analysis Service, the paper's co-first author. "When you get a cell line, you have to look that gift horse in the mouth ? there's up to a 40 percent chance it's a Trojan horse, not what it says it is."

For example, the cell line known as HES has been widely used as a "normal" model of endometrial cells since its development in 1989. There are literally hundreds of papers that, for example, look for differences between endometrial cancer cells and these supposedly normal HES endometrial cells. Unfortunately, HES is not, in fact, an endometrial cell line. It's another cell line known as HeLa which was first derived from cervical cancer.

"In the past, the technology to check cell lines didn't exist and so you can't really blame past researchers. But today it's cheap, it's easy and the technology is widely available. There's no excuse to experiment on cells without first discovering what you're experimenting on. We've suggested that journals start requiring verification of cell lines as a prerequisite of publishing," says Andrew Bradford, PhD, CU Cancer Center investigator and associate professor in the CU School of Medicine Department of Obstetrics and Gynecology, the paper's senior author.

"In fact, the process of double-checking a cell line is the same process that Scotland Yard uses to identify murderers based on DNA evidence," says Monique Spillman, MD, PD, CU Cancer Center investigator and assistant professor in the CU School of Medicine Department of Obstetrics and Gynecology, the paper's co-first author. Here's how it works: You have a sample that you know is endometrial cells from a specific patient and you have a sample that purports to be (but may or may not be!) endometrial cells ? is there a match? If so, you've convicted the suspect cell line. If not, as the team so often found, just as DNA mismatch has exonerated death row inmates, DNA mismatch showing that a cell line doesn't match it's label can call into question perhaps decades worth of research done using the cells.

While a misidentified cell line seems likely due to a SNAFU on the part of a lab assistant with a faulty filing system, there are more ways than clerical error to end up with the wrong label on a sample of cells.

"I see two people working with different cultures in the same hood, or using the same growth medium for the same cultures with the same pipette," Korch says. "And especially HeLa is superwoman ? it can fly." HeLa cells can travel in aerosols and once they land where they shouldn't, they're so adaptive and aggressive that they tend to out compete other cell lines wherever they land ? contamination leads to a quick HeLa takeover and perhaps a vial labeled HES when in fact it's HeLa.

"If you're going to make conclusions about endometrial cancer based on a cervical cancer line, your results are going to be flawed. It's not the same genetic pathways," Spillman says.

With his tongue only somewhat in his cheek, Korch reiterates Spillman's point, saying, "If you're studying prostate cancer with a cervical cancer cell line, you're going to have problems because men with prostates don't tend to have cervixes."

The work of Korch, Bradford, Spillman and colleagues including Twila Jackson builds on earlier work at the CU Cancer Center by investigators Rebecca Schweppe and Bryan Haugen who found 50 percent misidentification or contamination in available thyroid cell lines ? for example, two were melanoma lines and another was a colon cancer line. The recent research finds the same systemic problems with cell lines of widely varying types.

"When you bring new cells into the lab, you need to work meticulously and carefully," says Korch. "You need to put them into quarantine until you know what they are."

Korch is working to put the group's data online, both allowing investigators elsewhere to compare their cell lines to the group's controls, and also to help research groups discover what, if not as labeled, some of the cell lines they tested might be. Again like criminal DNA evidence, it's all about building a database large enough to include a match.

Until then, "People really need to check their cells," says Bradford. "It's just that simple."

US declassifies attacks in Yemen, Somalia

(AP) ? The White House is partially lifting the lid of secrecy on its counterterrorism campaign against al-Qaida in Yemen and Somalia by formally acknowledging for the first time that it is conducting lethal attacks in those countries.

The White House's semiannual report to Congress on the state of U.S. combat operations abroad, delivered Friday, mentions what has been widely reported for years but never formally acknowledged by the administration: The U.S. military has been taking "direct action" against members of al-Qaida and affiliates in Yemen and Somalia.

The report does not elaborate, but "direct action" is a military term of art that refers to a range of lethal attacks, which in the case of Yemen and Somalia include attacks by armed drones. The report does not mention drones, which are remote-controlled, pilotless aircraft equipped with surveillance cameras and sometimes armed with missiles.

The report applies only to U.S. military operations, including those by special operations forces ? not those conducted by the CIA.

"In all cases we are focused on those al-Qaida members and affiliates who pose a direct threat to the United States and to our national interests," Pentagon press secretary George Little said after the report's release. "This report contains information about these operations owing to their growing significance in our overall counterterrorism effort."

The report does not provide details of any military operations in either Yemen or Somalia. It merely acknowledges they have happened. Killings of terror suspects overseas are acknowledged by the administration, but it does not mention the involvement of drones. The CIA and military have separate drone fleets.

The decision by President Barack Obama to declassify the existence of the counterterror actions in those two countries amounts an incremental move toward greater openness about the use of U.S. force overseas. It does not reflect any change in the intensity or basic character of the U.S. campaign to defeat al-Qaida.

A previous step in the direction of greater official transparency came in April when the White House's counterterrorism chief, John Brennan, made the first formal confirmation that the U.S. uses armed drones against terrorists. But he did not mention their use in specific countries.

The new information in Friday's report comes amid outcries from some in Congress about leaks to the news media about details of classified activities such as the existence of a White House "kill list" of targeted al-Qaida militants. The accusation, mostly by Republicans, is that the White House has orchestrated the leaks to improve Obama's re-election chances, an allegation the president has rejected as "offensive" and "wrong."

Three administration officials who briefed The Associated Press on the decision to declassify the existence of the military's counterterrorism campaigns in Yemen and Somalia said Obama determined that the time was ripe, in part because the U.S. has built closer relations with the Yemeni government and with governments interested in eliminating extremist elements in Somalia. Somalia has not had a fully functioning government since 1991.

The officials said the declassification of further details in future reports to Congress would remain under White House review.

Under the War Powers Resolution of 1973, the White House is required to report to Congress every six months on U.S. combat operations abroad. Friday's report includes a secret attachment with classified details, which was not released publicly.

The last report, on Dec. 15, 2011, made no mention of Yemen or Somalia. Instead it said that in relation to efforts against al-Qaida, the U.S. was working with partners "with a particular focus on countries within the U.S. Central Command's area of responsibility," which is a broad swath of territory that includes the entire Middle East and Central Asia.

Friday's report was more explicit. It said that in Somalia the U.S. military has worked to counter the terrorist threat posed by al-Qaida and al-Qaida-associated elements of a militant group called al-Shabaab.

"In a limited number of cases, the U.S. military has taken direct action in Somalia against members of al-Qaida, including those who are also members of al-Shabaab, who are engaged in efforts to carry out terrorist attacks against the United States and our interests," it said.

It said the U.S. military also has been working closely with the Yemeni government to "operationally dismantle and ultimately eliminate" the terrorist threat posed by al-Qaida in the Arabian Peninsula, or AQAP.

It called AQAP "the most active and dangerous affiliate of al-Qaida today."

"Our joint efforts have resulted in direct action against a limited number of AQAP operatives and senior leaders in that country who posed a terrorist threat to the United States and our interests," the report said.

(AP) ? Neighbors say surgeon Timothy Jorden was meticulous about his work, his appearance and even the landscaping at his home.

So they suspected something was askew in his life this spring when he began putting less effort into things he previously approached with such care. The affable doctor also became less friendly and dropped about 75 pounds, they said.

They learned this week that police nationwide are searching for Jorden ? also a military-trained weapons expert ? following the audacious fatal shooting of his ex-girlfriend in a stairwell at the hospital where they both worked. They now wonder if the odd shift in his personality is somehow connected to the death of administrative assistant Jacqueline Wisniewski.

"I saw him at the beginning of the season and noticed how much weight he had lost," said June DuPree, a neighbor of Jorden's in an exclusive cluster of homes on a lakefront bluff. "He said, 'Yeah, I lost a little bit.' But it was more than a little bit. It was a lot. He wasn't too friendly that time I saw him. He just didn't want to talk."

In his Lakeview neighborhood south of Buffalo, Jorden clearly spent a lot of money to keep the grounds of his white, gabled home by the lake manicured and lush, residents say. But this spring, Jorden's bushes became overgrown, his grass grew knee-high and a kitchen remodeling job was halted.

"He had a lot of money invested in his house and the landscaping. And when I came back from Florida in May, it was really neglected. I was just shocked," neighbor Tom Wrzosek said.

"We presumed he was sick, that maybe he had some sort of major ailment," Wrzosek said.

"He was sick," he said. "But not in the way we thought he was sick."

Police across the country were on the lookout Thursday for the 49-year-old trauma surgeon. They say the former Army weapons expert may be armed and should be considered dangerous.

"He was an excellent surgeon. He saved so many lives. For him to take one is unreal," DuPree said.

The search for Jorden began Wednesday morning when the 33-year-old Wisniewski was found shot to death in a stairwell on the campus of the Erie County Medical Center. Police say she was shot four times.

Heather Shipley, a friend of Wisniewski's, told WIVB-TV that Wisniewski feared Jorden and that he wouldn't let go after she left him because she believed he was having affairs with other women.

She said Wisniewski told her the doctor had put a GPS tracking device in her car and once held her captive in her home for a day and a half, wielding a knife.

"She told me if anything happened to her, that it was him," Shipley told the station.

Jorden had been involved in two domestic incidents in neighboring Cheektowaga in 2003, police Capt. James Speyer said. He said that he couldn't release details but that the incidents did not involve Wisniewski.

Buffalo Police Commissioner Daniel Derenda on Thursday said a nationwide alert had been issued advising police agencies that he was wanted for questioning. Officers combed through the grounds outside his home, and for a second day, an Erie County Sheriff's helicopter circled overhead.

Derenda said all of Jorden's vehicles were accounted for and investigators were certain he had not crossed the nearby border into Canada.

"He's out there somewhere," he said.

The search comes after a lifetime of achievement for the divorced father of a grown son.

Jorden had been profiled in The Buffalo News as a homegrown success story in 1996 and was among those honored with Buffalo's Black Achievers in Industry award in 2002. As a surgeon at the city's main trauma hospital, he worked long hours and was always ready to respond to a hospital emergency when his cellphone rang.

Official: Egypt's Mubarak in critical condition

(AP) ? Egypt's ailing former president Hosni Mubarak is slipping in and out of consciousness eight days after he was transferred to a hospital inside a Cairo prison to serve his life sentence, a security official said on Sunday.

In order to squash rumors of his death, authorities granted his wife, former first lady Suzanne Mubarak, and her two daughters-in-law special permission to visit him early on Sunday morning, according to the official who spoke from inside Torah prison.

Since then, he has suffered from an irregular heartbeat and required assistance in breathing. The official told The Associated Press that Mubarak lives only on liquids and yogurt. He spoke on condition of anonymity because he was not authorized to speak to the media.

Mubarak's health is reported to have collapsed since his June 2 conviction for failing to stop the killing of protesters during the uprising that overthrew him in 2011. His life sentence saw him transferred immediately to a prison hospital, instead of the military hospital and other facilities where he had been held since his April 2011 arrest.

Authorities have turned down several requests by Mubarak's family to transfer the ousted president back to a military facility, the official said.

On Saturday Mubarak's wife was denied access to the Intensive Care Unit where he was placed, as authorities limit family visitations to one a month.

According to security officials quoted by al-Masry al-Youm daily, Mrs. Mubarak lashed out at wardens for not giving her husband permission to seek treatment outside the prison. "You will be responsible for his death," she allegedly said.

Mubarak's two sons Alaa and Gamal are also being held. They were acquitted on June 2 of corruption charges, but still face separate charges of insider trading.

On Saturday, Egypt's state run news agency MENA quoted officials as saying that Mubarak is at risk of stroke, quoting a medical team's report.

Other media reports said that his lawyer Farid al-Deeb informed him that he will soon be transferred back to a military facility in the Cairo suburb of Maadi.

In his last public appearance on June 2, the bedridden Mubarak sat stoned-faced in the courtroom cage. However, officials said that he broke into tears when he learnt that he will be transferred to Torah's prison. It took officials hours to convince Mubarak to leave the helicopter that ferried him from the courthouse to the prison.

Media reports quoted Mubarak at the time as saying the military council who took over after his ouster had deceived him. "Egypt has sold me. They want me to die here," he reportedly said.

The verdict sparked a new wave of protests by tens of thousands of Egyptians around the country who allege the verdict was determined by political pressure from the country's military rulers, doing a favor for their former president.

They say the verdict as issued can be easily overturned in an appeal, and that the acquittals of six top security officials mean that killers of the protesters will remain unknown. Many hoped Mubarak or his top officials would be convicted of murder and receive the death penalty.
